{"id":8691,"date":"2022-10-18T13:16:57","date_gmt":"2022-10-18T10:16:57","guid":{"rendered":"https:\/\/kaosaar.ee\/?p=8691"},"modified":"2022-11-02T13:27:35","modified_gmt":"2022-11-02T11:27:35","slug":"kaosaar-successfully-defended-the-registration-of-estonian-trademark-eesti-200","status":"publish","type":"post","link":"https:\/\/kaosaar.com\/en\/kaosaar-successfully-defended-the-registration-of-estonian-trademark-eesti-200\/","title":{"rendered":"K\u00c4OSAAR successfully defended the registration of Estonian trademark \u201cEESTI 200\u201d"},"content":{"rendered":"\n<p>The Board of Appeals dismissed an opposition against the registration\nof the word mark \u201cEESTI 200\u201d, filed by an Estonian NGO and a private individual\nbased on the earlier trademark \u201cEESTI 200\u201d and alleged well-known trademark\n\u201cEESTI 200\u201d (Decision No. 1828-o, 18 March 2022).<\/p>\n\n\n\n<p><strong>Background<\/strong><\/p>\n\n\n\n<p>On 3 May 2018 Estonian NGO Eesti 200 applied to register the word mark\nEESTI 200 in classes 16, 25, 35, and 41 (Application No. M201800462).<\/p>\n\n\n\n<p>The application was opposed before the Board of Appeal based on the\nearlier figurative trademark EESTI 200 in class 41, and alleged well-known word\nmark EESTI 200 in classes 12, 35, and 41.<\/p>\n\n\n\n<p>The opponents argued that the registration of the contested trademark was\nsimilar to the earlier trademarks and would take unfair advantage of the distinctive character or the repute\nof the earlier trademarks. The level of similarity was allegedly supported by\nthe fact that some members of the Estonian Parliament had formed a support\ngroup for the NGO Eesti Kultuur 200.<\/p>\n\n\n\n<p>The opponents also argued that since as\nof 3 May 2018, they had used the mark EESTI 200 for three years regarding\ncultural and social activities, organising public events, and publishing, the\nclassification of the contested trademark is identical to the goods and\nservices of the earlier trademarks.<\/p>\n\n\n\n<p>The applicant disagreed that the\nearlier sign EESTI 200 could be considered a well-known trademark since the\nopponents had not presented sufficient proof. The applicant also argued that\nbased on the proof that the opponents had presented, it was not possible to\nclaim that they had used the word mark as a trademark, i.e., as an indication\nof origin for economical purposes. The applicant was also of the opinion that\nthe presented proof was not enough to prove which of the opponents had used the\ntrademark and pointed out that the public should connect the trademark EESTI\n200 to both opponents equally.<\/p>\n\n\n\n<p>As a response to the opponents\u2019 statement\nthat their wordmark EESTI 200 was as of 3 May 2018 well-know and earlier, the\napplicant pointed out that since the opponents state the same date as\napplicant\u2019s trademark application date, the rights are created on the same date\nand therefor the rights have no priority in relation to each other. <\/p>\n\n\n\n<p><strong>The Board\u2019s decision<\/strong><\/p>\n\n\n\n<p>Although the Board of Appeals agreed with the opponent that the\nearlier registered trademark EESTI 200 and the contested trademark were in some\nparts similar, it considered that since the lists of goods and services were\ndissimilar, there was no likelihood of confusion on the part of the consumers.\nEven though the opponents had tried to present evidence regarding the use of\nthe trademark, it was not proven that the earlier registered trademark EESTI 200\nhad a reputation that the use of the applicant\u2019s trademark could take advantage\nof or be detrimental to.<\/p>\n\n\n\n<p>The Board also agreed with the applicant that the use of wordmark\nEESTI 200 for economical purposes was not proven and therefor it could not be\nconsidered a well-known trademark.\n\nAs a result of the proceedings, the Board of\nAppeals rejected the opposition and the registration of the applicant\u2019s\ntrademark EESTI 200 remained in force.\n\n\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Board of Appeals dismissed an opposition against the registration of the word mark \u201cEESTI 200\u201d, filed by an Estonian NGO and a private individual based on the earlier trademark \u201cEESTI 200\u201d and alleged well-known trademark \u201cEESTI 200\u201d (Decision No. 1828-o, 18 March 2022).
